If you are unable to come to an acceptable agreement with your spouse, you can proceed with litigation. Texas law promotes the involvement of both parents in the raising of the children as much as possible. Court decisions will be made on the basis of the children's best interests. You may also seek a court order for modification of visitation at any point after a divorce. This must be supported by evidence of a significant change in circumstances which would warrant the amendment. Whether an original order or a modification, it is important to achieve a specific determination regarding the rights and responsibilities of each parent. Without this, you may be left to defend your rights against the custodial parent in light of a direction such as "reasonable visitation". Any agreements should also be ratified by the court in order to protect you should you need to recourse to enforcement at a later time.
